DJ Little Danny of Waxploitation

Waxplotation, the Record Label, sent me an email requesting I remove this post.

Instead, I'll just clarify - DJ Little Danny is of no relation to the LA based record label Waxploitation Entertainment Group, Inc. He is a member of a group of Austin DJ's who go by the name Waxplotation.

I totally LAUGH at the claim that any trademark in this country is "incontestable" when in fact the two entities in question are two entirely DIFFERENT types of business. Playing records does NOT equate to producing records and artist management. These people in LA obviously don't understand that Austin photographers are a bunch of law school dropouts!

Oh, wait... I was laughing so much I forgot to point out that: Even a defensibly "exclusive" trademark is still TOTALLY contestable, because in the US of A we enforce trademark only by contest. Trademark is policed through civil action in this country, not by actual police! Instead of trying to think we're stupid, this guy should check out a law firm website like this one. And I quote: "You’re On Your Own – There Are No Trademark Police."

I can't stop laughing... I'm trying to second guess what this guy will say. He may try to claim that his mark is inherently distinctive due to its cleverness. However, I would counter that it has become a total cliche to add the -ploitation suffix to any word which ends in an -x or -cks sound. CLICHE does not pass my inherently distinctive BS test!!!!

Ah yes. Mary Sledd's one sentence blog post about Waxplotation is causing serious confusion in the market place. :)

They should credit the photos on their site instead of sending threatening emails.

Move along folks. Nothing to see here. We worked things out. :)

That said - I feel the Waxplotation labels pain. TM stuff is a pain! When I was battling Entertainment Weekly for using a Copyrighted photo (1/2 page - no pay - no byline) I found myself lashing out in a similar way. Didn't do me any good and I gave up, but I can relate to wanting to do something about the situation and going after easy targets.

BTW Today will be my second best traffic day thanks to this whole mess. Guess nice things come wrapped in legalize packages, sometime.
